RELEASE OF LIABILITY, WAIVER OF CLAIMS, ASSUMPTION OF RISKS AND INDEMNITY AGREEMENT (“The Release Agreement”)
BY SIGNING THIS YOU WILL WAIVER CERTAIN LEGAL RIGHTS, INCLUDING THE RIGHT TO SUE.

PLEASE READ CAREFULLY.

The following activities in this agreement, involved with StepIt Fitness include but are not limited to potential: Injuries, Risks, Damage to Personal Items, Hazards, and more. Students participating in StepIt Fitness and programs associated with StepIt Fitness are required to sign this release agreement, prior to participating. This agreement is to prevent students from suing StepIt Fitness, in a case of accident, death, or any other injury or hazard that may happen during a class or event.

TO: StepIt Fitness (the “Operator”) and THE MANUFACTURERS AND DISTRIBUTORS OF THE EQUIPMENT USED IN FITNESS PROGRAMS, and their respective directors, officers, agents, representatives, employees, volunteers, independent contractors, subcontractors, sponsors, successors and assigns (collective the “RELEASES”)

DEFINITIONS In this agreement the term “StepIt Fitness Programs” include all events, classes, provided by StepIt Fitness, use of steps, yoga mats, studio and gym and facilities, and/or instructor training.

ASSUMPTION OF RISKS I am aware that my participation in StepIt Fitness involves many risks that could result in personal injury, death, and/or damage to personal items.

Health: Strain on body, dehydration, lightheadedness, fainting, and high heart rate.

Premises: Defective steps or facilities. Risk of falls, collisions with objects or steps, equipment, or persons.

Advice: Neglectfulness advice regarding fitness programs

My actions and conduct of other persons, including neglectfulness on their part, may increase the risk of damage, loss, personal injury or death. I understand that the Releases may fail to safeguard or protect me from the risks, dangers, and hazards of StepIt Fitness, some of which are described above.

Despite the risks, dangers, and hazards of StepIt Fitness, and fully understanding such risks, dangers and hazards, I wish to participate in StepIt Fitness with the Operator & Instructor. I understand and accept ALL of the risks that may cause injury, death and loss. I understand the risks and would like to participate in a StepIt Fitness class, event, program or any other StepIt Fitness related activity.

INSURANCE I am aware that this release does NOT provide me with any insurance. If injured, or cause injury or property damage to a 3rd party participating in StepIt fitness, StepIt Fitness is NOT responsible. JURISDICTION with this agreement and any rights, duties, and obligations as between the parties to this Agreement shall be governed by and interpreted in accordance with the laws of the State of Utah. Any litigation involving parties to the Agreement shall be brought solely within the State of Utah and shall be within the exclusive jurisdiction of the Court of the State of Utah in Millard County District Court.
